1. Scope

These Terms & Conditions (“Terms”) apply to all purchases made through the online store available at arkyn.eu (“Store”).
They govern the contractual relationship between ARKYN Industries d.o.o. (“we”, “us”, “our”) and the customer (“you”, “your”).
Contract language is English.

2. Contracting Party

The purchase agreement is concluded with:

3. Eligibility

The Store is intended for customers aged 18 or older.
We sell to both consumers and business customers, unless explicitly stated otherwise.

4. Conclusion of Contract

  1. Product listings in the Store are non-binding.
  2. By clicking “Pay now” during checkout, you place a binding purchase order.
  3. You will receive an automated order confirmation email immediately after checkout.
  4. The sales contract becomes effective upon receiving this order confirmation.
  5. We do not store the contract text in a way accessible to you after checkout. Please save your order documents independently.

5. Prices, VAT & Payment

  1. All prices displayed in the Store are final prices and include VAT where applicable.
  2. The applicable VAT rate depends on the customer’s shipping destination and is calculated automatically during checkout.
  3. Accepted payment methods:
    • Shopify Payments
    • Credit/Debit Cards
    • PayPal
  4. Payment is due immediately upon placing the order.
  5. Any fees charged by your payment provider remain your responsibility.

6. Shipping, Delivery & Risk Transfer

  1. Orders are shipped from our warehouse in Croatia.
  2. We ship to most European countries. Available destinations and shipping charges are shown during checkout.
  3. Large items (roof boxes) are shipped via freight carrier / pallet delivery.
  4. Estimated delivery times are shown during checkout but are not guaranteed.
  5. The risk of accidental loss or damage transfers:
    • to consumers upon delivery;
    • to business customers once the goods are handed over to the carrier.
  6. Customers must inspect deliveries upon receipt. Visible damage must be documented with the driver and reported to us within 48 hours.

7. Retention of Title

The goods remain our property until full payment has been received.

8. Right of Withdrawal (Consumers Only)

Consumers within the EU have a statutory right to withdraw from the contract within 14 days, starting from the day the goods were received.

8.1 Withdrawal Consequences

  • If you withdraw from the contract, we will refund all payments received, excluding shipping upgrade fees (e.g., express freight).
  • Refunds are issued using the same payment method used for the original order.
  • We may withhold the refund until we have received the returned goods.

8.2 Return Shipping Costs

Unless otherwise stated, you bear the direct cost of returning the goods, including freight returns for oversized items.

8.3 Exclusions

The withdrawal right does not apply to:

  • Custom-made or personalized items
  • Items damaged due to improper use, deviations from the installation instructions, or mounting on non-approved vehicle surfaces (e.g., thin motorsport glass)

9. Warranty

  1. Consumers are entitled to a 24-month statutory warranty under applicable EU law.
  2. Business customers receive a 12-month warranty.
  3. Warranty does not cover:
    • Normal wear and tear
    • Damage caused by improper installation, misuse, or overload
    • Use on vehicles or surfaces explicitly excluded in our compatibility guidelines
    • Modifications to the product
  4. Warranty claims must be reported with photos and a detailed description.

10. Liability

  1. We are liable for intent and gross negligence without limitation.
  2. For negligent breach of essential contractual obligations (cardinal duties), our liability is limited to foreseeable damages.
  3. We are not liable for:
    • Indirect or consequential damages
    • Loss of profits
    • Improper installation or mounting outside the approved vehicle list
  4. Liability for injury to life, body, or health remains unaffected.
  5. Statutory product liability rules apply.

11. Compatibility & Installation Disclaimer

  1. Our roof boxes and mounts must only be installed on vehicle surfaces and roof rack systems explicitly approved in our compatibility guidelines.
  2. The customer is responsible for verifying their vehicle's suitability before installation.
  3. We accept no liability for damage resulting from:
    • Use on unsupported roof structures
    • Thin motorsport glass
    • Polycarbonate or acrylic glazing
    • Exceeding recommended speed limits
  4. Failure to follow installation instructions voids warranty and liability.
  5. Please note: The use of vacuum mounts on vehicle wraps (foils) is not recommended by ARKYN. The tension created by the vacuum may cause the foil to lift or stretch, compromising the safety of the mount. We recommend installation exclusively on original paintwork or glass surfaces.

12. Data Protection

Personal data is processed in accordance with our Privacy Policy, available separately in the Store.

13. Dispute Resolution & Online Dispute Platform

The European Commission provides an Online Dispute Resolution platform (ODR):

We are not obliged and not willing to participate in voluntary consumer arbitration procedures.

14. Liability Waiver & Assumption of Risk

By placing an order, you acknowledge and accept our Liability Waiver & Assumption of Risk, available here. You understand that installing or using our products may involve inherent risks, particularly when mounted on non-approved vehicle structures, thin motorsport glass, polycarbonate/acrylic surfaces, or when used outside the recommended installation and speed guidelines. You agree to assume these risks and release ARKYN Industries d.o.o. from liability for any resulting damage, except where prohibited by mandatory consumer protection laws or in cases of injury to life, body, or health.

15. Governing Law & Jurisdiction

  1. These Terms are governed by Croatian law, excluding conflict-of-law rules.
  2. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory protections of their country of residence.
  3. Jurisdiction for all disputes with business customers is Zagreb, Croatia.

16. Amendments

We may update these Terms from time to time. The Terms valid at the moment of purchase apply to that order.
