Liability Waiver & Assumption of Risk

1. General Acknowledgment

By purchasing, installing, or using any ARKYN product, you acknowledge that you have read, understood, and agreed to this Liability Waiver & Assumption of Risk.

You confirm that you are legally allowed to enter into this agreement and that you act on your own responsibility.

2. Customer Responsibility

You agree that:

  • You are solely responsible for correctly installing and securing the ARKYN roof box or mount.
  • You will follow all installation manuals, safety guidelines, and compatibility instructions provided by ARKYN.
  • You understand that improper installation can cause serious damage to your vehicle, third-party property, or personal safety.

3. Compatibility & Vehicle Suitability

You confirm that you have verified:

  • that your vehicle is suitable for the chosen mounting method,
  • that the glass, roof structure, or roof rack meets the minimum strength requirements,
  • that your vehicle is not listed among excluded models (e.g., thin motorsport glazing, polycarbonate windows, unsupported structures).

You accept full responsibility for mounting the product on a surface not explicitly approved by ARKYN.

4. Speed, Load & Use Limitations

You acknowledge and agree to:

  • respect ARKYN’s recommended maximum driving speeds,
  • avoid sudden acceleration, emergency braking, and extreme crosswinds when carrying the product,
  • regularly check vacuum integrity and mounting stability during use,
  • not exceed the maximum load capacity specified by ARKYN or your vehicle’s manufacturer.

Failure to comply may lead to loss of adhesion or structural failure.

5. Assumption of Risk

You understand and voluntarily accept all risks associated with:

  • driving with an externally mounted load,
  • aerodynamic forces acting on the product at speed,
  • potential detachment resulting from improper mounting or misuse,
  • use on unsuitable surfaces (e.g., thin glass, aftermarket lightweight windows),
  • ignoring safety checks before and during the journey.

You agree that you are fully responsible for ensuring the product is mounted safely and remains secure throughout use.

6. Waiver of Liability

To the fullest extent permitted by law, you waive any claims against ARKYN Industries d.o.o. for:

  • damage resulting from incorrect installation,
  • use beyond the stated limitations,
  • use on non-approved vehicle surfaces,
  • failure to perform regular safety checks,
  • exceeding recommended speeds,
  • damage caused by environmental conditions (wind, heat, cold, precipitation).

This waiver does not exclude ARKYN’s liability for intent, gross negligence, bodily injury, or mandatory statutory liability.

7. Indemnification

You agree to indemnify and hold harmless ARKYN Industries d.o.o. from any third-party claims arising from:

  • improper installation,
  • misuse of the product,
  • negligent driving behavior,
  • use on prohibited vehicle types or surfaces.

8. Mandatory Safety Confirmation

By completing your purchase, you confirm that:

  • you have read the Installation Manual and Compatibility Guidelines,
  • you understand all limitations of the product,
  • you acknowledge that your vehicle meets the structural requirements,
  • you will strictly follow all usage recommendations.


9. Binding Agreement

This waiver becomes legally binding upon completing checkout and applies to all current and future ARKYN products purchased by you unless revoked or amended in writing.

10. Governing Law

This waiver is governed by Croatian law.

For consumers, mandatory protections of your country of residence remain unaffected.
